Introduction:

The purpose of the Code of Conduct is to set out the basic rules of THD. All learners are expected to adhere to these and failure to do so may result in suspension or exclusion from classes.

Obligation of Learners

  • Attend classes regularly and be on time. Your trainer and the THD Training Team can help you if your circumstances mean that this is not always possible.
  • Respect all the people in THD, whether learners, staff and trainers.
  • Behave in a way which respects the needs of others to learn, teach and work.
  • Respect the property of THD, of staff and other learners.
  • Help keep the institute clean and tidy.
  • Study to the best of your abilities and hand in any set work on time.

Unacceptable Conduct

The following are examples of behavior considered as misconduct and may result in disciplinary action being taken:

  • Putting the health and safety of others in danger.
  • Conduct which prevents obstructs or disrupts teaching, learning, or theadministration of the business of training.
  • Failure to follow the reasonable instructions of a member of staff and trainer.
  • Disruptive or disorderly behavior or the use of bad or abusive language.
  • Any form of intimidation, bullying, neglect, discrimination, or abusive behavior whether physical, emotional, financial, or sexual.
  • Offensive behavior or language to others, including references to race, disability, gender, sexual orientation, age, faith, or religion.
  • Causing damage to THD’s center, equipment, books, or furnishings.
  • Interference with software, belonging to or used by THD or misuse of computer facilities.
  • Bringing alcohol or drugs on THD premises or drunkenness or the use of illegal drugs.
  • Any illegal act in the premises of THD

Academic Misconduct

THD defines academic misconduct as any case of deliberate, premeditated, cheating, falsification of information, to deceive and gain an unfair advantage in assessment.

Disciplinary Procedures

Phase One:

The trainer involved or Training staff must raise the issue of misconduct or behavior with the learner. This must be recorded and/ or reported to the Training Manager responsible for the area of provision. Information must be factual and free from judgments and personal comments. Documentation must be signed, dated and subject to confidentiality.

Phase Two:

  • Where there is evidence of continued misconduct, the Training Manager will arrange to meet with the learner about their misconduct/behavior. They should be advised that they may wish to consider bringing someone along to the meeting to support them.
  • Result of the meeting may include:
  • Agreed actions (which will be recorded and kept on file for one year)
  • Formal written warning will be kept on file for one year.

Phase Three:

  • Where phase two is not followed, or gross misconduct re-occurs, the Training Manager must report directly to THD Management who will deal with the matter urgently.
  • Written notification will be given to inform the learner in writing of:
    • The allegation and evidence to substantiate the allegation.
    • A request to hold a meeting giving the venue, time, and date of meeting
  • The learner’s entitlement to have another person present. THD management will make its decisions known which may result in:
    • No further action taken.
    • The learner receives a final written warning.
    • Further investigation takes place before a final decision is made.
  • THD management will confirm decisions, and reasons for decisions, in writing to the learner within one week which will be implemented with immediate effect.
  • The learner will have the right to appeal within one week from receipt of the decision stating any grounds for appeal. Any grounds for appeal will be considered, however, THD management’s decision is final.

Appeals Procedure

  • The learner will have the right of appeal to the Training Manager. Notice must be given by the learner within five working days of receipt of the decision and must state the grounds for the appeal.

  • THD management will convene an appeal. The Training Manager who made the decision in the first stage of the procedure will be asked to present THD’s case and explain the reasons for the recommendation.
  • The learner will be invited to explain the grounds of the appeal and state his or her case.
  • THD management may ask questions of the learner and of the representative presenting the case and will then consider whether to allow or dismiss the appeal. Witnesses will normally be asked to be on call to answer any questions.
  • If the appeal is allowed, THD management may decide on lesser disciplinary action, or no disciplinary action. If the appeal is dismissed, THD management will issue a statement confirming that the decision taken at the first stage of the procedure is upheld.
THD management’s decision is final and will be confirmed in writing (or in other formats when appropriate) to the learner within five working days.
